Agreement to Terms

By accessing and using Pawikan Divers' services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not use our services.

Pawikan Divers provides the following services in Cebu, Philippines:

Scuba Diving Services

Discover Scuba Diving (introductory dives)
CMAS certification courses (Open Water to Instructor levels)
Fun dives for certified divers
Specialty diving courses

Water Sports & Activities

Island hopping tours
Jet ski rental
Parasailing
Banana boat rides
Snorkeling

Equipment & Facilities

Diving equipment rental
Safety gear provision
Boat transportation
Professional instruction

Booking Confirmation

All bookings must be confirmed in writing (email, SMS, or Messenger)
Bookings are subject to availability
We reserve the right to decline bookings at our discretion

Minimum Requirements

Advance booking: Recommended 48-72 hours in advance
Group bookings: Minimum 3 days advance notice for groups of 6+
Same-day bookings: Subject to availability (not guaranteed)

Payment Terms

Accepted Payment Methods

Cash (Philippine Peso - PHP)
Bank transfer (local Philippine banks)
GCash

Payment Schedule

Deposit: 50% required to secure booking
Full Payment: Due 24 hours before activity
Walk-ins: Full payment required upfront

Age Requirements

Scuba Diving

Discover Scuba: Minimum 10 years old
Certification Courses: Minimum 10 years old
10-14 years: Junior certification (limited depth)
15-17 years: Parental consent and supervision required
18+ years: No parental consent required

Water Sports

Jet Ski: Minimum 16 years old (with parental consent if under 18)
Parasailing: Minimum 12 years old
Banana Boat: Minimum 8 years old
Island Hopping: All ages welcome

Health & Safety Requirements

Cannot Participate If You Have:

Heart conditions or high blood pressure
Respiratory disorders (asthma, COPD)
Ear/sinus problems
Epilepsy or seizures
Diabetes (insulin-dependent)
Recent surgery (within 3 months)
Pregnancy

Medical Clearance Required

If you answer "YES" to any CMAS medical questionnaire question, you must provide a doctor's clearance before diving.

Alcohol & Drugs

No alcohol 12 hours before diving
No recreational drugs 24 hours before any activity
No diving/water sports if under the influence

Liability & Assumption of Risk

Inherent Risks

Scuba diving and water sports carry inherent risks, including but not limited to:

Decompression sickness (the bends)
Drowning
Marine life encounters
Equipment malfunction
Weather-related incidents
Physical injury

Assumption of Risk

By participating, you acknowledge and accept these risks. You agree that Pawikan Divers is not liable for injuries resulting from your failure to follow instructions, pre-existing medical conditions, acts of God, or third-party negligence.

Insurance

We strongly recommend purchasing:

Dive insurance (DAN)
Travel insurance
Medical evacuation insurance

Participant Responsibilities

You Must:

✅ Arrive on time (late arrivals may forfeit booking)
✅ Follow all safety instructions from staff
✅ Use provided equipment properly
✅ Disclose all medical conditions
✅ Sign liability waivers before participation
✅ Maintain a buddy system while diving
✅ Respect marine life and coral reefs

You Must Not:

❌ Dive beyond your certification level
❌ Touch or harm marine life
❌ Damage coral reefs
❌ Remove any marine organisms
❌ Litter or pollute
❌ Engage in reckless behavior

Weather & Force Majeure

Weather Cancellations

We reserve the right to cancel or modify activities due to:

Storms, typhoons, or severe weather
Rough seas or poor visibility
Government warnings or restrictions

Refund Options:

Full refund, or
Reschedule to another date (free of charge)

Code of Conduct

We expect all participants to:

Treat staff and other participants with respect
Follow Philippine laws and regulations
Respect local culture and customs
Behave responsibly and courteously

We reserve the right to refuse service or expel participants who: Harass staff or other customers, endanger themselves or others, damage property, or violate these terms.

Governing Law

These Terms are governed by the laws of the Republic of the Philippines. Any disputes shall be resolved through good-faith negotiation, mediation, or arbitration in Cebu City.
